April 2018

HR Tampa has selected Eckerd Connects – Raising Hope for 2018 Expo Charity

Our April 16th Chapter meeting kicked off our fundraising efforts for Eckerd Connects - Rooms for Hope. We are selling Blue Pinwheels throughout the meeting for $5.00/each “in memory of” and “in honor of” which will be on display at our annual conference and expo on October 12th.

Why Blue Pinwheels?

In 2008, Prevent Child Abuse America introduced the pinwheel as the new national symbol for child abuse prevention through Pinwheels for Prevention®. What our research showed, and what our experiences since then have borne out, is that people respond to the pinwheel. By its very nature, the pinwheel connotes whimsy and childlike notions. In essence, it has come to serve as the physical embodiment, or reminder, of the great childhoods we want for all children.

SCOTUS Rules That Car Dealership Service Advisors Are Exempt, Puts the Brakes On Overtime Claims
Submitted by:  William Grob, Legislative Director, HR Tampa
Authors: Alfred B. Robinson, Jr. and S. Arsen, Ph.D., Ogletree Deakins

In its April 2, 2018, decision in Encino Motorcars, LLC v. Navarro, the Supreme Court of the United States issued its second opinion in this case and definitively ruled that automobile service advisors are exempt from overtime under section 213(b)(10)(A) of the Fair Labor Standards Act (FLSA). The sole question before the Court was whether a service advisor is a salesman who is “primarily engaged in . . . servicing automobiles.” In a 5-4 decision, Justice Thomas wrote for the majority stating that the best reading of the statutory text leads to the conclusion that service advisors are exempt from overtime because they are salesmen in that they do make sales of services for vehicles and they are primarily engaged in servicing automobiles.

The Court’s opinion comes less than two years after it had ruled that the FLSA’s overtime exemption must be construed without placing controlling weight on a 2011 U.S. Department of Labor (DOL) rule according to which service advisors were not exempt. This time, the Court ruled that the service advisors are “obviously” salesmen and, therefore, exempt. Encino Motorcars, LLC v. Navarro, Supreme Court of the United States, No. 16–1362 (April 2, 2018).

Katelyn Kasper, President HR Tampa Student Chapter #5568

Jennifer Walker London Internship

Jennifer is the Vice President of our HR Tampa Student Chapter and has been active in Chapter activities over the past year. Jennifer’s article describes her Academic Studies Abroad internship. We are very proud of Jennifer’s accomplishments.

My name is Jennifer Walker and I am a Junior at the University of Tampa studying Psychology with a double minor in Business Administration and Leadership Studies. I’m so excited to announce that I will be completing a human resource internship abroad in London this summer through Academic Studies Abroad. I will be studying abroad through June and July, working roughly 25 hours a week. While my placement with a company has not yet been determined, I’ll be working with a well-established company in the heart of London. While in London, I will be working with a company to learn about the dynamic and global aspects that human resources can offer. My goals for this internship includes learning about the basics of human resources, as well as being able to globalize the practices of human resources across different countries. I hope to infuse my knowledge gained from being abroad to my future human resources experiences in the states and offer a unique perspective.

Being involved in the HR Student Chapter has taught me valuable information about entering and succeeding in the HR field that I would not have gained otherwise. HR Tampa helped me receive this internship abroad by helping with my interviewing and resume skills. I’m happy to say that the support I’ve received from HR Tampa continuously encourages me to better myself and strive to learn more about the human resources field! Thanks so much!
